Distance Sales Agreement and Preliminary Information

Terms for service orders such as domain name, hosting, SSL and static IP.

Last updated: October 2, 2026

1. Parties

SELLER: Kültür Medya Bilgi Teknolojileri ve Danışmanlık Hizmetleri Tic. Ltd. Şti.. Address: Altıtop Mah. 1591 Sok. No:13 Kent Ofis Daire:15, Merkezefendi / Denizli. Email: [email protected]. Phone: +90 532 301 81 08.

BUYER: The natural or legal person who provides name, title, email, phone and (if any) tax and address details in the order form.

2. Subject matter of the agreement

This agreement governs the rights and obligations of the parties relating to the sale and performance of domain name registration/renewal, hosting, SSL certificate, static IP and similar services ordered electronically by the BUYER from the https://kulturmedya.com website, within the framework of Law No. 6502 on Consumer Protection and the Distance Contracts Regulation.

3. Basic characteristics and price of the service

The type, duration, quantity and price of the service are shown in the order cart. Prices are stated in US Dollars (USD) and on an annual basis, exclusive of VAT; VAT and the total amount are calculated separately in the cart. The payment method and the exact amount (the exchange-rate equivalent, if any) are communicated to the BUYER after the order has been reviewed. Submitting the order form does not create an obligation to pay; the agreement is formed when the SELLER confirms the order and the BUYER makes the payment.

4. Provisions specific to domain name orders

The availability of a domain name is shown by an instant query; the query result is not a reservation or a guarantee of registration. The SELLER re-verifies availability before registration. If the domain name is not available or the application requirements (e.g. identity/tax documents for .tr extensions) cannot be met, the order cannot be fulfilled and, if payment has been made, it is refunded in full.

The domain name is registered in the BUYER’s name with the information provided by the BUYER; the accuracy of the registration information is the BUYER’s responsibility. Renewal of domain names must be made before expiry in accordance with the registrar’s rules; the SELLER is not responsible for the suspension or deletion of expired domain names, but will try to notify the BUYER as the renewal date approaches.

5. Performance and delivery

The services are performed electronically. Domain name registration, SSL and static IP assignment are carried out after payment and the necessary information have been completed; access or technical information is sent to the BUYER’s email address or account. The estimated performance time depends on the processing times of the registrar and the certificate provider.

6. Right of withdrawal

If the BUYER is a consumer, pursuant to Article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for services performed instantly in an electronic environment or for services whose performance has begun with the consumer’s approval before the withdrawal period expires. Services whose performance begins instantly or at the BUYER’s request, such as domain name registration, SSL and static IP assignment, fall within this scope; by confirming the order, the BUYER accepts that they request performance to begin within the withdrawal period.

For orders whose performance has not begun, the BUYER may withdraw without giving any reason within 14 days of the order by written notice to [email protected]; if payment has been made, the amount is refunded within 14 days of notification of the withdrawal.

If the BUYER is a merchant or a legal entity (not a consumer), the Distance Contracts Regulation and the provisions on the right of withdrawal do not apply.

7. Cancellation and refund

Detailed conditions are set out on the “Cancellation and Refund Terms” page, which forms an integral part of this agreement.

8. Obligations

The BUYER accepts that the order information is accurate and that the service will be used for lawful purposes. The SELLER performs the service with due care and in accordance with the rules of the relevant registrar, certificate provider and infrastructure. The SELLER cannot be held liable for delays caused by force majeure and third parties (registrar, infrastructure).

9. Personal data

The BUYER’s personal data is processed within the scope of the KVKK Privacy Notice. The BUYER declares that they have read this text.

10. Dispute resolution

In consumer transactions, in the event of a dispute, applications may be made to the Consumer Arbitration Committees at the place of residence of the BUYER or the SELLER within the monetary limits applicable in the relevant year, and to the Consumer Courts for disputes exceeding those limits. For a BUYER who is not a consumer, the Courts and Enforcement Offices of Denizli have jurisdiction.

11. Entry into force

By ticking the relevant confirmation box in the order form, the BUYER declares that they have read, understood and accepted this agreement and the preliminary information terms electronically.
