1. Parties and subject matter
This agreement is entered into between Kültür Medya Bilgi Teknolojileri ve Danışmanlık Hizmetleri Tic. Ltd. Şti. (“Kültür Medya”) and the person or organization (“Member”) that creates a customer account (membership) at https://kulturmedya.com. The agreement governs the terms of use of the membership account.
2. Membership conditions
To become a member, you must be of legal age and, if you represent a legal entity, be authorized to do so. The Member accepts that the information provided during registration is accurate, current and complete, and is obliged to update any changes through their account. Only one membership may be opened with the same email address.
3. Account security
The Member is responsible for the confidentiality of their username (email) and password and for the transactions made through their account. If unauthorized use is suspected, Kültür Medya must be notified without delay. Kültür Medya may temporarily restrict the account for security reasons.
4. Scope of the account
The membership account is provided so that the Member can manage their company information and view records of domain name, hosting, SSL, static IP and similar services, together with renewal dates and amounts. The information shown in the account view is for informational purposes; exact amounts and terms are determined by order and invoice documents.
5. Service orders
The Member may request domain name, hosting, SSL and similar services through the website. These orders are additionally subject to the provisions of the Distance Sales Agreement and the Preliminary Information Form.
6. Intellectual property
The software, design, logos, text and images on the website belong to Kültür Medya or its licensors; they may not be copied, distributed or used for commercial purposes without permission.
7. Prohibited use
The Member may not use the account in a way that harms the site, attempts to circumvent security, makes excessive queries with automated tools, produces content contrary to law or public morals, or infringes the rights of third parties. In the event of a breach, the account may be suspended or closed.
8. Limitation of liability
Kültür Medya does not guarantee that the service will be uninterrupted or error-free; it cannot be held liable for indirect damages arising from force majeure, infrastructure or third-party interruptions. This clause does not affect liabilities that cannot be limited by law.
9. Personal data
The Member’s personal data is processed within the scope of the KVKK Privacy Notice and the Privacy Policy. The Member declares that they have read these texts.
10. Termination
The Member may request closure of their account at any time at [email protected]. Kültür Medya may terminate the membership in the event of a breach of this agreement. Obligations relating to ongoing services are not affected by termination; records subject to a legal retention obligation are not deleted.
11. Amendments
Kültür Medya may update this agreement; the current text takes effect on the date it is published on the website. Continuing the membership constitutes acceptance of the current text.
12. Disputes
Turkish law applies to disputes arising from this agreement. The Courts and Enforcement Offices of Denizli have jurisdiction; the jurisdiction rules applicable to consumers in consumer transactions are reserved.
